1. Scope of Application

All deliveries, services and offers of neeka GmbH, Kronenplatz 19, 77652 Offenburg, Germany, shall be made exclusively on the basis of these GTC. Any deviating terms and conditions of the customer that have not been expressly acknowledged shall not be binding.

2. Offer and conclusion of contract

The neeka GmbH's website does not constitute an offer. By clicking the button "Order with obligation to pay" in the last step of the checkout, you submit a legally binding purchase offer. Immediately before submitting this order, you can recheck and correct it if necessary.

You will receive an automatically generated confirmation of receipt of your order. A contract is not yet concluded by the confirmation of receipt. A contract is only concluded with the dispatch of the goods or through an order confirmation (within three working days at the latest).

All offers are directed solely to customers of legal age.

3. Right of revocation

You have the right to revoke this contract within 14 days without stating reasons. The revocation period is 14 days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

To exercise your right of revocation, you must inform us (neeka GmbH, Kronenplatz 19, 77652 Offenburg, telephone number: +49 (0) 781 205 538 46, e-mail address: kontakt@neeka.de) by means of a clear declaration, e.g. a letter sent by post, of your decision to revoke this contract. You can use the attached sample revocation form for this purpose, which is, however, not mandatory. 

To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

4. Consequences of revocation

If you revoke this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the favorable standard delivery we offer), without undue delay and at the latest within 14 days from the day on which we received the notification of your revocation of this contract. Reimbursement will take place by the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than 14 days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of 14 days. You shall bear the direct costs of returning the goods.

You will only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

5. Delivery conditions

We deliver exclusively within Germany and the European Union (not Switzerland) by parcel service (UPS, DHL, dpd). Delivery time is 3 to 5 working days (from order; with prepayment from receipt of payment).

6. Prices and shipping fees

All prices include VAT and do not include shipping costs. Shipping costs EUR 5.50 within Germany and 13.99 in other EU countries.

7. Payment methods and conditions

Payment options are prepayment, credit card, and Paypal.

8. Retention of proprietary rights

The goods remain the property of neeka GmbH until full payment has been received.

9. Transfer of risk

Risk shall pass to the Purchaser as soon as the consignment has been handed over to the persons carrying out the transport or has left the warehouse for the purpose of shipment. In case of purchase by private consumers, the risk shall pass only upon handover. 

10. Warranty

Legal warranty rights apply.

11. Place of fulfilment, jurisdiction

The place of performance for all obligations and the place of jurisdiction for all disputes arising from the contractual relationship is Offenburg, insofar as the contractual partner is a merchant or a legal entity under public law.

12. Salvatory clause

Should any clause of these terms and conditions become invalid, the validity of the remaining terms and conditions shall remain unaffected.

13. Online Dispute resolution

The European Commission provides a platform for online dispute resolution, which can be found at http://ec.europa.eu/consumers/odr/ . We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
